Notice of Privacy Practices

American Premier is dedicated to protecting the privacy and security of your health information, in accordance with the Health Insurance Portability and Accountability Act (HIPAA), the latest 2025 federal updates, and Arizona state law.
Our Legal Responsibilities
We are required by law to:
- Maintain the privacy of your Protected Health Information (PHI)
- Provide you with this Notice of our legal duties and privacy practices
- Clearly inform you how your information may be used and disclosed
- Abide by the terms of this Notice currently in effect and notify you in the event of any breach affecting your PHI
How We Use and Disclose Your Health Information
Your PHI may be used or disclosed for:
- Treatment: Coordinating your healthcare or managing your treatment with other providers.
- Payment: Activities to obtain payment from you, an insurance company, or a third party.
- Healthcare Operations: Quality improvement, accreditation, training, audits, and general business operations.
We may also disclose information as required or permitted by law, including:
- To public health authorities
- For reporting abuse, neglect, or certain injuries or diseases
- As required by court orders or law enforcement
- As necessary in the event of a serious threat to health or safety
You will be asked for written consent for other uses, such as sharing information for publicity or marketing.
Your Rights
As a patient, you have the right to:
- Access your medical records and request copies (within 15 days as required by 2025 regulations)
- Request corrections to your health records if you believe they are incorrect or incomplete
- Receive an accounting of disclosures stating when and why your PHI has been shared
- Request restrictions on certain uses/disclosures (unless law prohibits these limits), including restricting the release of behavioral health records
- Request confidential communications (such as receiving mail at an alternate address)
- Obtain estimated fee schedules for access to your PHI and learn when access may be free of charge
- File a complaint without retaliation if you believe your privacy rights have been violated

HIPAA & Arizona State-Specific Rules
- Enhanced Patient Data Access: You may inspect health records in person, take notes/copies, and expect prompt responses (within 15 days).
- Shorter Breach Notification: You will be notified of any data breach involving your PHI within 45 days, per Arizona requirements, which are stricter than the federal standard.
- Restricting Sharing of Information: Arizona law recognizes your right to restrict the release of your own or your emancipated minor’s medical and behavioral health information.
- Recent Updates: Some federal HIPAA rules regarding reproductive health record confidentiality were expected for 2025 but are not in effect as of July due to litigation. We remain committed to updating this notice as required by regulation changes.
Safeguarding Your Information
We employ administrative, technical, and physical safeguards to protect your information, including staff training, secure electronic systems, and strict policies for releasing and storing information. For electronic records, new regulations require robust cybersecurity, including multi-factor authentication and third-party security audits.
Changes to This Notice
We may update this policy in response to legal or regulatory changes. The most recent version is always available on our website or upon request.
